hereafter referred to as \"Atelier des Sens/Chefsquare\"

AND:

Any person wishing to make a purchase or a booking via Atelier des Sens/Chefsquare website www.atelier-des-sens.com, hereafter referred to as \"the user\" or \"the customer\".

The parties agree that their relations shall be governed exclusively by this contract, excluding any condition published beforehand on the website. Atelier des Sens/Chefsquare has the right to modify its general terms and conditions at any time. In this case the applicable conditions will be those valid on the date the user places an order. If any condition is not fulfilled, it shall be considered as being governed in accordance with legislation in the sector of distance selling for companies with their headquarters in France.

OBJECT

The objective of these conditions is to define the terms of sale between Atelier des Sens/Chefsquare and the user, and ordering services, as well as payment and delivery.
They deal with all the steps necessary for placing an order and ensure order tracking between the contracting parties.

CARACTERISTICS OF THE GOODS AND SERVICES ON OFFER

Atelier des sens/Chefsquare sells cookery training courses and food-related gifts on its website.
The only goods and services on sales on-line are those which feature on the Atelier des Sens/Chefsquare course calendar, subscription page and gift shop the day the order is placed.
These products and services are available while stocks and places last.
The other Atelier des Sens/Chefsquare products and services such as group courses and corporate events are not for sale on-line.
The photographs on the site are provided for illustrative purposes.
Atelier des sens/Chefsquare has the right to alter the recipes on the program, notably depending on the vagaries of the fresh food market.
If a trainer is unexpectedly absent, Atelier des Sens/Chefsquare can replace him/her with another trainer who has equivalent qualifications.
Atelier des Sens/Chefsquare has the right to reschedule or cancel courses in the case the unexpected absence of a trainer or if there are insufficient trainees enrolled. If the course cannot be rescheduled at a later date suitable to the customer, the amount charged for the course will be refunded.

Subscriptions are made by name but up to two places per course can be booked with one subscription : one place for the subscribed customer and one for the guest of his/her choice.
If this is the case, extra course bookings must be paid for on-line by credit card. Subscriptions run using an hour counter system which is debited each time a booking is made. Hours are purchased using the prices applicable on the date of the transaction. Hours are valid for a maximum of one year, as from the date of purchase.

Gift vouchers are by name and their us is strictly personal. Gift vouchers are valid for one year as from the date of issue and will not be accepted beyond this date of validity unless an exceptional extension of 3 months has been applied for before the expiry date. This extension is non-renewable and is priced at 20 Euros incl. VAT. Gift vouchers, like subscriptions and bookings, are non-refundable.

PRICES

Prices are given in euros including all taxes. Their VAT is the rate applicable on the day of ordering. Atelier des Sens/Chefsquare’ VAT number is FR83453055725.

The prices given for courses include training materials in digital format, ingredients, use of the equipment needed to follow a course properly and for tasting. Atelier des Sens/Chefsquare has the right to change its prices at any time. It is however understood that the price which appears on the order from which is validated by the user at the time of payment is the only price applicable for the order in question.

ORDERS

The order can only be registered on the website of the user is clearly identified by entering his/her details, email login and password.
All orders suppose acceptance of the prices and of the description the products and services on sale.
When the order is confirmed this means these general terms and conditions have been accepted.
The booking of places for a Chefsquare in-person cooking class is limited to 5 places per user. For a reservation of 6 places or more, your request must be the subject of a personalized quote, please contact us on commercial@chefsquare.fr
Atelier des Sens/Chefsquare is committed to fulfilling the orders received on its website only while places are available for bookings and while stocks last for gift orders. If no places or products are available, Atelier des Sens/Chefsquare will undertake to inform the user.
All the data provided and registered order confirmation constitute proof of the transaction. In line with the French Civil Code, validation of the order form is the equivalent of signature and acceptance of the operations carried out.
The registered order confirmation will be sent by email to the address given by the user after payment as been validated.
If payment is made by check, the order will only be processed once the check has been received and under the condition that places are available on the date of order processing.
Atelier des Sens/Chefsquare has the right to refuse any order in the event of an existing dispute with the user.

PAYMENT

Payment must be made when placing an order.
Payments by credit card on the website are secured by our banking partner CIC using SSL protocol so that communicated data is software encrypted and that no third party can gain any knowledge during information communication on the network.

DELIVERY

Delivery is only applicable for gifts ordered.
Delivery can only be carried out in France.
Deliveries are made to the postal address indicated by the user on the order form.
Gift vouchers can be sent by email or by «first class».
Gift parcels are sent by the Postal Service \"Colissimo 48 h\" service.
Delivery lead times are in line with Postal Service Office lead times and subject to its responsibility. Atelier des Sens/Chefsquare disclaims responsibility in the event of any problems concerning the conveyance of mail, strikes, absence at the indicated address, the wrong address given or an address unknown to the Postal Service, or the wrong email address given for delivery by email.

RIGHT OF WITHDRAWAL / RETURN / EXCHANGE

Once an order has been paid for it cannot be refunded. A booking can only be rescheduled at the customer’s request if this request is sent by email and arrives at Atelier des Sens/Chefsquare at least 72 hours before the course commences. The customer can make a new booking within a time limit of 3 months as from the date the course was cancelled, provided that the validity date is over, or equal to, 3 months. It is possible to cancel a Cooking Academy course 7 days or more before the course commences.

RESPONSABILITY
Atelier des sens/Chefsquare cannot be held responsible for any damages resulting from the use of the Internet network such as loss of data, intrusion, viruses, service failure or any other unintended problems.
The website may contain links to other websites that Atelier des sens/Chefsquare does not run. Atelier des sens/Chefsquare cannot be held responsible in any way for these links being posted allowing access to these sites and external sources, as concerns their content, advertising, products, services or any other material available on or from these sites or external sources which have not been checked not approved by its teams.
Atelier des sens/Chefsquare is committed to making the utmost efforts to provide updated and accurate information. The company would not be held responsible for any error and/or omission relating to this information.

PERSONAL DATA AND «MY ACCOUNT» SPACE

The information and personal data that Atelier des Sens/Chefsquare requests from the user are reserved for its own use. The user has the right to access, change, rectify and delete information which concerns him/her (Clause 34 of The Data Protection Act, Law No 78-17). To exercise this right you should contact: Atelier des Sens/Chefsquare – 40, rue Sedaine, 75011 Paris, France and include a copy of your ID document or passport as identification. This automatic processing of information, in particular managing email addresses, is subject to declaration to the CNIL (The Information Commissioner’s Office) (declaration n°1271932).
To place an order, the first time the user has to open a customer account on line so that he/she can register his/her details, email login and password. The password is strictly confidential and must never be communicated to a third party. The customer alone is responsible for the use of his/her password by a third party. He/she can ask the Atelier des sens/Chefsquare for a new password.
Using this account, the user can consult his/her order history, invoices and bookings in progress, change his/her details if necessary and validate his/her orders and bookings without having to enter his/her details again. It is clearly stipulated that bank details are not registered on this account. For each new order, the user must provide his/her credit card details using the secured CIC payment system interface.

INTELLECTUAL PROPERTY

Atelier des Sens/Chefsquare , the www.atelier-des-sens.com website and its content are protected by trademark law and/or author’s rights and other rights. All these items remain the exclusive property of Atelier des Sens/Chefsquare. Under the provisions of the Intellectual Property Code and the laws and regulations of all countries and international conventions, any representation and/or reproduction, as well as any use, operation (whether complete or partial) of one of any of the abovementioned items which is done without the prior, written consent of Atelier des Sens/Chefsquare, is forbidden.

TRANSACTION TRACE AND ARCHIVING - PROOF

Order forms and invoices are archived using a reliable, long-lasting system so as to provide a an exact and durable replica, in line with clause 1348 of the Civil Code. The computerized records shall be considered a proof of the communication, orders and payments effected between the parties.

GOVERNING LAW AND JURISDICTION

These conditions are subject to French law. The competent court in the event of litigation shall be the one pertaining to the home address of the defendant or the claimant can choose the address pertaining to the effective delivery of the product.
